Whether you are trying to start your family or desiring to add a child to your existing family, Roskind Law can help. 

The following is a short summary of some key adoption definitions & issues:

Birth Mother: the woman offering her child for adoption.

Biological Father: the biological father of the adoptive child.

Surrender: the birth mother surrenders her parental rights to the child.  The birth mother signs a document in front of the judge acknowledging she is giving up her parental and legal rights to the child.

Surrender Revocation Period: the birth mother has TEN days from the date of the surrender to revoke her surrender.  This is typically the adoptive parents' most nervous period of time.  Although each adoption is separate and distinct, surrender revocations are relatively rare.

Adoption Petition: the legal document filed in court asking that the adoptive parents become the legal parents of the adoptive child.

Direct Placement Adoption: soon after birth, the adoptive child is placed in the care of the adoptive parents.

Step-Parent Adoption: when, after marriage, the step-parent and the biological parent (spouse) request that the step-parent be recognized as the legal parent of the child.

Relative Adoption: when a relative requests to be recognized as the legal parent of the child.

Termination Proceedings: generally speaking, each and every child can only have two legal parents.  Regardless of the type of adoption, the rights of the other biological parents (non-adoptive parent(s)) must be terminated.  In the case of a stepparent adoption, the natural-parent spouse of the child retains his/her parental rights; however, the other natural parent's legal rights must be terminated. 

A biological parent may voluntarily terminate his/her parental rights in conjunction with an adoption proceedings.  Should the biological parent refuse to voluntarily terminate his/her parental rights, the adoptive parent(s) may request that the court terminate his/her parental rights.  Tennessee recognizes several grounds for terminating parental rights.

Timing: Generally adoptions are not finalized until the Adoption Petition has been on file for six months.  If the adoptive child has lived with the adoptive parents for at least six months, the court may finalize the adoption before the Petition has been on file for six months.
